Driver takes speeding ticket all the way to state appeals court, loses

WEST WINDSOR -- A state appeals court has affirmed the speeding ticket issued to a woman clocked driving 92 miles per hour on a stretch of Route 1 in West Windsor.

A municipal court judge fined Lynn S. Price, of Trenton, $200 - along with $33 in court costs and a $6 surcharge - for speeding in a 55 miles-per-hour zone following a March 2013 stop.

Price appealed in Mercer County Superior Court, where a judge upheld the ticket and fines, issuing a written opinion in October 2014, the appeals decision handed down Monday says.

Representing herself, Price then took her case to the state's appeals division, arguing several points earlier this month.

Among them was a decision by the municipal court not to grant a postponement of her case, which she says caused "structural error that affected the legitimacy of the entire trial."

Price also alleged several errors by the municipal court at trial - including illegal evidence, an impartial judge and prosecutorial ethical lapses.

"Even if the West Windsor Municipal Court had not committed the above referenced violations, the evidence introduced at trial was legally insufficient to prove  defendant guilty beyond a reasonable doubt," Price argued, according to the appeals decision.

The appeals panel was not moved by any of Price's arguments, saying they sided with the superior court judge's decision, noting: "Defendant had six weeks' notice of the trial of this speeding ticket for which she claims she was unprepared."

The appeals judges said their review of the case finds the police radar evidence was properly admitted into evidence, the Monday decision says. "We are satisfied that the state proved all of the elements of the offense of speeding beyond a reasonable doubt."

West Windsor police said Price's ticketing was unremarkable.

Price was pulled over during a police radar operation on a Saturday morning shortly before 7:30 a.m. on Route 1 north near Meadow Road. A number of other vehicles were also pulled over, police said Tuesday.
