Pa. residents fighting Trenton-Mercer flyovers ask town for money

Bucks Residents for Responsible Airport Management (BRRAM), asked Lower Makefield, Pa. for money to aid their legal fight against flyovers.

EWING -- A group of Bucks County, Pa. residents who oppose the number of flights in an out of Trenton-Mercer Airport recently asked the town of Lower Makefield, Pa. for money for their legal efforts.

The town's governing body did not seem too receptive, the Bucks County Courier Times newspaper reported.

Lower Makefield resident Holly Bussey, a member of Bucks Residents for Responsible Airport Management (BRRAM), and the group's lawyer William Potter, appeared at a recent Lower Makefield supervisors meeting to see if the town would be willing to contribute more township money toward BRRAM legal fees.

Two Lower Makefield supervisors said they would rather the group, seek more money from Upper Makefield and Yardley rather than more from Lower Makefield, the paper reported.

Lower Makefield has contributed $15,000 to BRRAM in its fight over Frontier Airlines' flights, while Upper Makefield has pitched in $10,000 and Yardley $2,000, the paper reported.

BRRAM filed suit in April 2014 in the midst of rapid expansion by Frontier Airlines at the Trenton-Mercer Airport, arguing that flyovers negatively impacted their livelihood with unwanted noise.

In the suit, Potter, of Princeton, argued the FAA should have conducted a review and prepared an environmental impact statement considering the effect expanded use of the airport would have on neighboring residents.

A federal judge in New Jersey dismissed the lawsuit in May 2015, ruling the court did not have the jurisdiction to hear the case.

BRRAM appealed to the U.S. Third Circuit Court of Appeals in Philadelphia and that effort is ongoing.

Court filings in the case show this week that Potter and BRRAM filed for an received an extension to file briefs in the case by Feb. 1.
